  • The words, code, and artwork here are ours. Read them and share links freely; do not republish the site as your own.
  • The site is informational, and provided as is. We keep it as accurate as we can, but a page here is not a promise about what any app does on your machine.
  • Downloads come from the product sites. A link here hands you off to a site with its own terms.

1. Agreement to these terms

These Terms of Use (the “Terms”) are an agreement between you and Clearware, LLC covering your use of the website at clearware.co. By visiting or using the site, you agree to them. If you do not agree, please do not use the site.

Our Privacy Policy explains what this website does and does not collect, and it forms part of these Terms.

2. What this website is

clearware.co is an informational site. It describes who we are and what we make, and it links to the individual product sites where our apps are documented and distributed. It has no account, no shopping cart, no form, and no paid tier, because there is nothing here to pay for.

We may change, reorganise, or remove any part of the site at any time, and we may stop publishing it altogether. Nothing here is an offer, or a commitment to keep any particular page, product, or feature available.

3. Permission to use the site

You may read this site, print or save pages for your own reference, and link to it. That permission is personal to you and revocable, and it transfers no ownership of anything.

Please do not:

  • republish, mirror, or sell the site’s content, or present it as your own;
  • use our copy, artwork, or code to build a competing product or service without our written permission;
  • scrape, crawl, or automate against the site in a way that degrades it for other people;
  • probe, scan, or attempt to breach the site or the systems that serve it, or bypass any technical measure protecting them;
  • misrepresent your affiliation with Clearware, or use our name or marks in a way that suggests we endorse you.

4. Our intellectual property

The Clearware name and logo, our product names, and the text, layout, artwork, and code of this site are owned by Clearware, LLC or used with permission, and are protected by copyright, trademark, and other laws. These Terms grant you no licence to them beyond Section 3.

Third-party names and marks that appear on the site belong to their respective owners, and are used to identify those products — not to imply any affiliation or endorsement.

5. The apps are licensed elsewhere

Clearware’s applications are not licensed by these Terms. Each product has its own Terms of Use and end-user licence: that is the document that grants you permission to install and run the software, sets out how the free app is funded, and disclaims warranties for it. You accept it when you install the app.

Read the terms for the specific app you install. They control for that product, they are more detailed than anything on this page, and where they differ from these Terms about the software, they win.

Some Clearware apps have no site of their own — Outcast, for example, lives at clearware.co/apps/outcast. That page is a description, not a distribution point and not a licence: when such an app is released it ships with its own terms, presented wherever you obtain it.

6. Downloads and third-party sites

This website does not serve application installers. Download links here take you to a product site or an app store, each with its own terms and privacy policy, and your use of those destinations is governed by their rules rather than these.

We also link to sites we do not control. A link is not an endorsement, and we are not responsible for the content, accuracy, or practices of anywhere you end up after leaving clearware.co.

7. Accuracy of what you read here

We write these pages carefully and correct them when we find them wrong, but product descriptions change as the products do, and this site may at times be out of date or contain errors or omissions.

Where a page here disagrees with a product’s own site, documentation, or terms, treat the product’s own materials as authoritative. Nothing on this site is legal, financial, or technical advice.

8. No warranty

The site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the maximum extent permitted by law, Clearware, LLC will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data or profits, arising out of or related to your use of this website — including anything that follows from relying on information published here, or from visiting a site we linked to.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Liability for the apps is addressed in each product’s own terms (Section 5).

10. Changes to these terms

We may update these Terms as the site evolves or the law changes. When a change is material we will update the effective date above and post the revised Terms here before the change takes effect. Continuing to use the site afterwards means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Delaware are the venue for any dispute about them. If you are a consumer, this does not deprive you of the protection of the mandatory law where you live.

If any part of these Terms is held unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it.
